Official Contest Rules
To obtain a copy of these official contest rules either (a) visit our website at www.waaf.com; (b) visit our studios during business hours at 20 Guest Street, 3rd floor Brighton, MA or (c) send a self-addressed stamped envelope to: “WAAF AC/DC Guitar Contest Rules,” 20 Guest Street, 3rd floor – Brighton, MA 02135.
WHO CAN ENTER:
1. Entrants must be legal residents of the States of MA, RI, CT, NH or VT 18 years of age or older. Entercom Boston LLC d/b/a 93.7 WAAF (“Station”) may require proof of age, identification and/or social security number prior to delivering a prize.
2. Employees of the Station, World of Wheels, other participating sponsors, and their parents, subsidiaries, affiliated companies, advertising and promotion agencies (collectively with Station, “Sponsors”), and the immediate family members or household members (i.e., spouses, parents, grandparents, children, grandchildren, siblings and housemates) of each of the above are NOT eligible to enter and/or to win.
3. Multiple entries will be accepted but no more than one finalist per household will be permitted.
HOW TO ENTER:
4. No purchase is necessary to enter or win.
5. There are three way to enter:
(a) Listen to the Hill-Man Morning Show weekdays between 5:30am and 10:00am from January 2, 2008 through January 4, 2008. Each contesting morning the Hill-Man Morning Show will make one (1) announcement to call the Station’s studios at (617) 931-1223 when they hear the contest initiated on-air (calls to other numbers, including for example, the Station’s main telephone number, will not be eligible to enter this contest). The first caller to get through to (617) 931-1223 and correctly answer the Hill-Man recall trivia question (“Trivia Question”) will win a “key,” subject to confirmation of eligibility. If the first caller does not answer the question correctly the next caller will be taken until a caller answers the question correctly. Station reserves the right to stop taking calls for a particular contesting solicitation if there is no correct answer within 30 minutes of the initial on-air announcement and Station may or may not re-schedule that play of the contest at a later time (as announced on-air), in Station’s sole discretion. The Contest will be judged by Station personnel, and the decision of the judges will be final as to all matters, including (i) the order in which calls were received and (ii) whether any answer required to be given is correct. Up to three (3) Qualifiers will win a “key” through this mode of entry and will have the opportunity to participate further in this contest.
(b) Listen to WAAF between 10:00am and Midnight from December 24, 2007 through January 4, 2008 (excluding holidays). During those dates, between those hours, Station will make a totals of twenty-two (22) announcements to call the Station’s studios at (617) 931-1223 when they hear the contest initiated on-air (calls to other numbers, including for example, the Station’s main telephone number will not be eligible to enter this contest). The seventh (7th) caller to get through to (617) 931-1223 will win a “key,” subject to confirmation of eligibility. Up to ten (22) Qualifiers will win a “key” through this mode of entry and will have the opportunity to participate further in this contest.
(c) Members of the AAF Army may enter by completing a specific on-line entry form for this contest between December 24, 2007 at ___am though January 2, 2008 at approximately 11:59am. Go to www.waaf.com and click on the “AAF Army” icon, which will then direct you to the sign-in page (or registration page for non-members who wish to become members in order to participate in this contest). Members will then be required to click on “Win a signed AC/DC Guitar” and then and complete and submit an entry form with your name, address, and phone number. On or about January 2, 2008 (after 12pm), Station will randomly select twenty (25) entrants to win a “key,” subject to confirmation of eligibility. Twenty five (25) Qualifiers will win a “key” through this mode of entry and will have the opportunity to participate further in this contest.
Winning a “key” simply means that the winner will have the opportunity to attend the grand prize event and select a key at that event for a chance to win the grand prize, subject to confirmation of eligibility and compliance with these rules.
6. The AAF Army is an internet club that will entitle members to, among other things, receive information from WAAF and its clients, enter contests, participate in surveys and enjoy many other opportunities. There is no cost to become a member of the AAF Army. To join the AAF Army go to www.waaf.com and click on the link “AAF Army” and provide all required information (incomplete registrations may be invalidated in Station’s sole discretion). In the event of a dispute regarding the identity of a member, the holder of the e-mail account will be deemed the person who submitted the membership. The holder of the e-mail account is the natural person who is assigned the e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the second level domain associated with the e-mail address in question. Limit one membership per person and one membership per e-mail address. Members are required to provide truthful information when completing Eagle Club membership registration form. If Station determines that any registration form contains false or fraudulent information or is submitted by a person other than the one named in the form or by an ineligible entrant, such form will be disqualified and that member will be prohibited from participating in this contest. All AAF Army members who are ineligible entrants in this contest will be deemed void for the purpose of entering this contest. All Army registrations or contest entries received that are tampered with or from ineligible entrants will be void. Incomplete registrations or contest entry forms may be disqualified in Station’s sole discretion.
7. If the Station did not have actual contact (in person or telephonic) with the winner as part of the contest, Station will only be required to leave one message at to the number provided in the entry form. If no answer, response or answering machine is reached, Station will not be obligated to attempt any further contact. However, Station reserves the right, in its sole discretion, to attempt to contact any winner more than once and shall not be required to attempt to contact all winners an equal number of times or in the same manner/mode.
8. Only those calls to the specific phone number provided at the time calls are solicited shall be eligible to win. All calls received from ineligible Entrants will be void. By calling the Station, each Entrant gives permission and consents to Station’s recording and/or broadcasting contestant’s name, voice, participation, and the substance of the Entrant’s telephone call. Entrant agrees that no additional compensation will be paid for such usage.
9. Station is not responsible for any entries, internet connections and/or telephone calls that are misdirected, lost, stolen, disconnected, not received, or are illegible. Station not responsible for any printing or typographical errors. All entries become the property of the Station and will not be acknowledged or returned.
HOW TO WIN:
10. ALL QUALIFIERS WHO WON A “KEY” IN THIS CONTEST MUST BE PRESENT AT THE WORLD OF WHEELS AT BAYSIDE EXPO CENTER (200 Mount Vernon St Dorchester, MA 02125) ON OR BEFORE 5:30PM ON January 5, 2008 IN ORDER TO BE ELIGIBLE TO PARTICIPATE FURTHER IN THIS CONTEST. See “Use of Proxy” below.
11. Any Key winner who fails to register and check in by 5:30pm at the Bayside Expo on January 8, 2008 will be automatically disqualified from any further participation in this contest. All timely arrivals will have their names put into a random drawing. When a name is drawn, that person will step up and draw an actual key out of a separate bin that contains a number of keys equal to the number of key winners who checked in a timely manner. The person will then take that key and insert it into the padlock. If that key opens the padlock, that person wins the Grand Prize. This process will be repeated until a key that was drawn opens the padlock.
12. ONCE THE PADLOCK HAS BEEN OPENED BY A DRAWN KEY, NO OTHER KEYS WILL BE TRIED AND THE CONTEST WILL BE ENDED.
13. If all the keys are tried and due to a mechanical failure, none of the keys open the padlock, the Grand Prize will be awarded at the conclusion of the event by means of a random drawing from the names of all qualified attendees who participated in the key drawing.
14. In the event that a Grand Prize Winner is disqualified, for any reason, at any time, one name will be drawn at random from the names of all of the qualified Key winners who were present (in person) at the giveaway event, minus the name(s) of the disqualified former Grand Prize Winner).
15. All Key winners hereby agree to strictly follow all instructions and directions given by the Station staff at the giveaway event and understand that any intentional failure to comply with the key selection process and procedures at the giveaway event or any attempt to trade, purchase, or otherwise procure a key other than that which each Key winner initially drew will result in immediate disqualification. Keys are not transferable.
16. Prior to drawing for keys, all key winners are required to sign a Release and Eligibility Affidavit which, among other things, relieves and releases the Station, World of Wheels and their sponsors from any and all liability with respect to any injuries, losses or damages of any kind caused by or resulting from (a) participation in the contest and/or (b) the acceptance, possession and/or use of any prize awarded hereunder. Any person who refuses to sign the Release will not be eligible to participate in the grand prize event. Notwithstanding the absence of such executed Release, all contestant acknowledge and agree that by participating in the WAAF AC/DC Guitar Contest that Station, World of Wheels and their parent, subsidiaries, officers, directors, employees, agents, contest sponsors and affiliated companies, and advertising and promotion agencies accept no responsibility of liability in connection with of the foregoing.
17. Use of a Proxy: An authorized proxy (“Proxy”) may participate in this contest in the place of the qualified winner provided that the following conditions are met: (i) the Proxy must satisfy the “Who Can Enter” requirements above, (ii) Proxy must either present a notarized, fully completed and signed official proxy form from the selected winner identifying and authorizing the Proxy to participate in his/her place and to sign the required release form on his/her behalf or the winner must be present at the time of the drawing to sign the official proxy form (together with either a valid driver’s license or passport); (iii) the Proxy must present his/her own photo identification and proof of age; and (iv) the Proxy and the qualified winner must sign an agreement which, among other things, releases the Station and Sponsors which acknowledges that all rules contained herein have been complied with on the selected winner’s behalf. Official proxy forms are available at the Station studios. It is the sole responsibility of Finalist to request a Proxy Statement, if desired, and have it completed prior to and submitted at the event on January 8, 2008.
PRIZE(S)/ODDS OF WINNING:
18. One (1) prize of a Autographed AC/DC Guitar (“Grand Prize”) (approximately $750 value) will be awarded. Winner shall be solely responsible for obtaining and payment of any federal or state required registration, inspection, insurance coverage, and taxes. Additional information regarding the pick-up/delivery, and additional information will be mailed to the winner within 20 business days of winning the prize. Winner will be required to complete all relevant documents and to pick up the guitar at WAAF during regular business hours.
19. Qualifiers will each win (a) a pair of tickets to the World of Wheels event on January 5, 2008 (valued at $25) and (b) an opportunity to participate in the Grand Prize event via receiving a “key” at that event in accordance with these rules. No more than 50 “Keys” will be awarded.
20. The odds of winning the Grand Prize is dependant upon the number of eligible entries received. For all Key winners, the odds of winning will be no more than 50:1.
21. Prizes will be released to winner only.
22. Failure to collect the prize and deliver all required payments and forms within 30 days of receiving written notification that the prize is ready for delivery to winner will constitute forfeiture of the prize. If forfeited, the prize will remain the property of the Station.
23. Prizes are not redeemable for cash. No substitution, transfer or assignment of prizes is allowed; provided, however that Station may substitute any prize for one of greater or equal value.
24. Station and Sponsor are not responsible for replacing or reimbursing any entrants with any form of compensation for cancellations. All cancellations are deemed beyond the control of Station and Sponsor. This includes, but is not limited to, event cancellations, delays and postponements of any form and duration due to acts of nature, war, terrorism or any other reason. Station is not responsible for any expenses incurred by entrants as a result of such cancellations or rescheduled events.
25. Station reserves the right to reschedule the Grand Prize Event in the event of any act of God, terrorist threat or attack, war, cancellation of the World of Wheel expo, weather conditions or any other reason beyond the reasonable control of Station. In such event, Station will use reasonable efforts to notify qualifiers of such rescheduled event but Qualifiers shall be required to listen on-air to WAAF and check-in on online at www.waaf.com for the latest information about the event (including postponements) and any re-scheduled grand prize event.
26. Winners are responsible for paying all applicable local, county, state and federal taxes on prizes based on the estimated retail value of the prize, as set forth in these Contest rules, and will be issued an IRS 1099 form for all prizes won from Station where the aggregate value of all prizes is $600 or more.
OTHER RULES:
27. Station Management shall be the sole arbiters in all matters relating to the contest and in the interpretation of contest rules. Their decisions shall be final. Entry into the contests constitutes agreement by contestants to abide by these rules, as well as any other rules established by Station.
28. By participating in a Station contest, entrants hereby agree that Station has no responsibility or liability in connection with any injuries, losses or damages of any kind caused by or resulting from the acceptance, possession and/or use of a prize or an entrant’s participation in any such contest.
29. By participating in a Station contest, entrants hereby consent to the Station and contest sponsors’ usage of any one or more of the following for on-air broadcast and for any other advertising and promotional purposes in any media without payment of additional consideration: contestant’s name; voice; likeness; biographical information; his/her participation in the contest; and the substance of the contestant’s telephone call.
30. Complete contest rules are available at the Station studios at 20 Guest Street, 3rd floor Brighton, MA 02135 during normal business hours of 8:30 a.m. to 5:30 p.m., Monday through Friday or by going online at www.waaf.com. Name of winner will be available after January 7, 2008 by sending an self-addressed stamped envelope to 20 Guest Street, 3rd floor Brighton, MA 02135 c/o “WAAF Ac/DC Guitar Contest Winners List” by January 31, 2008.
31. Station contests are subject to all applicable laws and regulations and are void where prohibited.
32. Station is not responsible for any technical difficulties experienced due to overload, busy signals, loss of phone service, electronic problems or any other factor that may prevent an individual from completing a phone call or for any technical malfunction related to any telephone connection, servers, routers, or any other technical problem that may impact entry or prize claim including, without limitation, any internet telephone call connections.
33. Station reserves the right to: (i) terminate or declare any Contest null and void and rescind any prize, if in its sole judgment, the rules or the integrity of the Contest have been violated or compromised in any way, intentionally or unintentionally by any person whether or not a participant in the Contest; (ii) alter or amend these Contest rules at any time; and (iii) stop or conclude the Contest at any time without prior notice. Material changes to the contest rules will be broadcast on-air, when practical.
34. These are individual contest rules. To the extent that these individual contest rules differ from WAAF’s general contest rules, these individual contest rules will govern and control.
